The protection of your personal data (hereinafter called "Data") is very important for us, so that the protection of the data and your confidentiality represents a priority for us. This Confidentiality Policy shall be read together with the Cookie usage policy, an integral part of the Confidentiality Policy.

Data collection and use

You can use our website without disclosing your personal data.

Personal data shall be collected and used for the following processing purposes ("Processing Purposes"):

1.  for prospecting, by collecting and processing the information from public sources about potential customers and providers of goods and services in the field of activity of Hidroconstructia (the legitimate grounds of the processing being the legitimate interest of Hidroconstructia in its capacity of personal data operator);

2.  for bidding, prior to concluding trading contracts, for the purpose of checking and approving the potential contractual partners: customers, providers of goods and services and partners (the legitimate grounds of the processing being both for taking the necessary measures prior to concluding a contract, as well as the legitimate interest of Hidroconstructia in its capacity of personal data operator for diminishing the contracting risks);

3.  for fulfilling the legal obligations, in view of fulfilling the legal obligations, in view of elaborating the financial-accounting documents, reporting to the public authorities and internal audit (including for fulfilling the obligations of taking any measures for preventing and combating anti-money laundering or terrorist acts funding operations);

4.  in the context of concluding and executing commercial contracts, including for sending any communications related to the carrying out of the contract:

•  personal data of associates, legal representatives/administrators and contact persons (employees or collaborators) designated for executing the contract belonging to the contractual partner;

5.  in the context of analyzing and in order to respond to the requests/demands received by Hidroconstructia;

6.  for sending any commercial communications/invitations to collaborate on the Hidroconstructia projects, for taking the necessary measures prior to concluding a contract;

7.  for ensuring the safety of goods and spaces for carrying out the activities of Hidroconstructia, by installing and operating the video processing systems.

Any personal data communicated during the registration process shall be processed by Hidroconstructia, in its capacity of operator within the meaning of the general Regulations on the data protection, the Romanian legislation on data protection and other applicable regulations.

Your data shall be used exclusively for the purposes of processing for which it has been initially collected. The data can be processed for a legal purpose, other than the processing purposes only to the extent that this purpose is correlated to the Processing Purposes. In case the data processing is wanted for other purpose than the Processing Purposes in accordance with the Confidentiality Policy hereby, we will provide you, before any processing, relevant detailed information regarding the processing.

You will be requested to provide correct and full data to Hidroconstructia. The non-compliance of this requirement represents a breach of the Confidentiality Policy hereby and entitles Hidroconstructia to interrupt any communication or trading relation with you. You also agree to update the data and ensure that it is correct and complete as well as, in the case of trading partners – customers, goods or services suppliers and partners, legal persons, to ensure the adequate information of the contact persons with regard to the disclosure of personal data by Hidroconstructia and their processing for the purposes of concluding and executing the commercial contracts with Hidroconstructia.

Our policy is that of not disclosing, sharing or making available the data to third parties, otherwise than it is provided in the Confidentiality Policy hereby.

Assistance and support

You may request assistance or you may ask us any questions, comments, suggestions or issues regarding the website, products and services of Hidroconstructia or with regard to the personal data processing by contacting Hidroconstructia at the addresses that are in the "Contact" section on the Website. Please provide us with as much details as possible for us to be able to answer your request (such as your full name, phone number and e-mail address). Your data shall be used exclusively for the purpose of analysing your request, and, in case it is accepted by Hidroconstructia, for taking all necessary measures in view of providing an answer to such a request.

The refusal to provide these details may prevent us from analysing or answering your request.

In view of including such a link, the approval by Hidroconstructia or the association with its operators is not necessary. We advise you to be careful when you leave our website and read the confidentiality statement of each website collecting personal data. This Confidentiality Policy applies exclusively to the information collected by Hidroconstructia.

Recipients of the data transfer

Hidroconstructia may disclose personal data to third parties, like the commercial partners of Hidroconstructia, acting as representatives for and on behalf of Hidroconstructia. (e.g. the legal and financial consultants) with which Hidroconstructia has concluded the necessary contractual agreements provided by the EU legislation and the national legislation. We will disclose data to third parties exclusively to the extent in which it shall be in the interest of the Processing’s Purposes for which the data is collected and processed. You expressly agree to disclose the personal data to the representatives.

Hidroconstructia may disclose the data in view of complying with the law or as an answer to the request of a court or another legal authority, like a mandate or a citation. Hidroconstructia may impart information in case we consider, in good faith, that it is necessary to prevent frauds or to settle any issues with respect to them or to protect Hidroconstructia.

The data shall not be transfered outside the EU/EEA.

Retention period

The personal data collected and used shall be stored and used for a period of 3 years after the end of the commercial relations, or for any other longer period provided by the law, by an applicable regulation for keeping the records or by the public authorities.

Immediately after the end of the applicable storage period, the data shall be:

(a)  deleted or distroyed safely; or

(b)  transferred in an archive (except for the case in which this is forbidden by law or an applicable regulation for keeping the records).

Safety

Hidroconstructia has taken all organizational and technical measures in order to ensure an adequate safety level for reducing the risks of processing, particularly against destruction, loss, alteration, disclosure or unauthorized access, willingly or accidentally, to the personal data. Hidroconstructia is certified ISO 27001:2013 for the safety of the information regarding the construction works with 2016.

You shall be notified in case of breaching the data safety, within a reasonable period of time after discovering the breach, except for the case in which a state body or organ establishes that the notification would hinder a criminal investigation or might put in danger the national safety. In this case, the notification shall be delayed according to the instructions of the competent body or organ. We will promptly respond to your questions regarding the breach of data safety.

Rights of the Concerned Persons

According to the regulations on the processing of the data in force, you are entitled to obtain the confirmation of Hidroconstructia (without any cost, within the limit of a request per year) with regard to the processing of your data and, if applicable, to access the data and the following information: the purpose of processing, the involved data, the data recipients, the storage period, your rights according to the regulations on the data protection and data source (in case you are not the one who has provided the data to Hidroconstructia).

You are also entitled to obtain from Hidroconstructia, without delay, the rectification of the incorrect data. You are entitled to request the deletion of the data or the restriction of processing only if all the conditions for such an operation are fulfilled in accordance with the applicable legislation.

You are entitled to the data portability (receiving personal data in a structured format, frequently used and that can be read by a computer and sending them to another operator) and the right to oppose, on grounds regarding your situation, at all times, the processing of your personal data, including the elaboration of profiles, if the processing of personal data is based on a legal interest followed by Hidroconstructia or by a third party.

Except for the case in which the processing of your data is necessary for concluding or executing a contract, you have the right of not being subject to the decision based only on the automatic processing, including the elaboration of profiles, that produce legal effects which concern or affect you significantly.

Modifications

The Confidentiality Policy hereby may be modified, and the modifications shall be displayed on our website, so that you should have permanent access to the details regarding the information that we collect, to the way in which and under what conditions they are used. Any modification shall enter into force immediately after the publication on our website.

Under the conditions in which we decide to use the personal data in a different manner than that mentioned at the moment of collection, we will notify you by e-mail.

The requests for the access, correction, restriction or deletion of the processing must be made in writing and are subject to the legal restrictions in force.

We will make sure that all adequate measures for settling your request shall be taken without delay and, in any case, within 30 (thirty) days from receiving the request. The answer shall be sent by electronic means, except for the case in which you request otherwise, in writing.
